Arbitration, the State, and Liberty

ABSTRACT

Conferees evaluated the degree to which modern forms of business arbitration facilitate the private enforcement of contracts and law in civil society. The main questions addressed concerned the extent to which such an order depends on, or is independent of, state support and whether or not such private processes facilitate ethical behavior and self-government.
